Elek Miller

Elek Miller practices in the areas of intellectual property and technology, labor & employment, and general school law.  He works with public and private sector organizations to find efficient, effective, and creative solutions to legal issues in these areas.

As part of his intellectual property and technology practice, Elek helps companies acquire and protect their trademarks, copyright and other IP.  As the practice group leader for the Privacy & Data Security Team, he also advises clients on compliance with state and federal data privacy and security laws, helps them create and negotiate complex privacy-related technology agreements, and assists them in the development of information security and privacy programs (including data breach prevention, response, and crisis management) and drafting related policies and protocols.

Elek works with public and private-sector employers on wage and hour issues, employee leave questions, hiring and firing employees, drug and alcohol testing at the state and federal level, drafting employment agreements for many types of positions, from administrative support staff to high-level medical service providers, and complying with state and federal employment laws.  He also advises and represents schools in front of state and federal courts and administrative agencies on a wide range of issues, including student discipline and student rights; the employment of teachers, school administrators, and other employees; compliance with state and federal laws; and the implications of the use of various forms of technology.

Elek is a frequent presenter at conferences and events related to privacy & data security, labor and employment, and school law.  Since 2013, he has also been an adjunct professor at the University of Southern Maine, teaching a course on school law for future school administrators.
