PLENARY: Maine Legislative and Workers' Compensation Board Update

What’s it all about? We open the first full day of Comp Summit with a look at the legislative session past and anticipated changes to the Maine Workers’ Compensation Act. Some look to the proposed legislation with hope, others with trepidation. We’ll explore the reality of what happened from three distinct vantage points: John Rohde, Executive Director of the Workers’ Compensation Board; Elizabeth Brogan from the Workers’ Compensation Coordinating Council; and Ben Grant from McTeague Higbee. Plus, we will be inviting key legislators to the table as well. Executive Director Rohde also will tell you a bit about the agenda for the Board meeting to take place later this afternoon, and other matters before the Board.

Special Guests As you know, the Legislature has been called into session on this Monday. Schedules permitting, we will welcome Senator Shenna Bellows and Representative Dick Bradstreet, who played key roles in the recent legislation.

PLENARY: New Angles on Return to Work

Time to Roll Up Your Sleeves!

What’s it all about? Once an employee has been injured on the job and receives medical care, the claim may just be starting. An appropriate return to work, with input from all parties, often is the best route to a successful resolution for the injured worker and the employer. This session focuses on the issues and challenges employees, employers, insurers, and the attorneys who serve them face when bringing injured workers back into the fold. We’ll look closely at a wide range of options with and without accommodation. Nelson Larkins leads this participatory session on a critical component of a healthy and functioning workers’ compensation system.

Why you’ll want to participate in this session.

  • Share ways to keep communication lines open, understand the connection to ongoing medical treatment, make effective return to work offers, and help employees back to appropriate work.
  • Discuss the use of independent medical examinations and functional capacity evaluations, the development of alternative work, and written job offers.
  • Learn how to create an environment where employees want to engage in a return to work.
  • Consider the tools available when an employee does not reasonably return to work, including the Petition for Review of Incapacity, and when settlement of the claim is a valid option.

What’s it all about?  You are welcome to participate in the regularly scheduled business meeting of the Workers’ Compensation Board.

Participants: Executive Director John Rohde. Labor Members Emery Deabay, Ron Green, and Glenn Burroughs. Management Members Tom Davis, Richelle Wallace, and Gary Koocher.

  • Watch the Maine Workers’ Compensation Board in action, comprising 3 voting members from labor, 3 voting members from management, and the executive director.
  • Hear the latest developments from the past legislative session and any additional commitments to support or oppose particular pieces of legislation.
  • Learn about the status of rule-making before the Board and hear the reports from the executive director and general counsel.
