21-Day Reductions/Discontinuances & Motions for Provisional Orders
Here’s a forum on how to position a case for success early in the process – replete with strategy thinking and tactical gems. From the employer and insurer perspective, we’ll focus on obtaining the right evidence for an ALJ to uphold a discontinuance. This may include proper medical documentation, avoiding physicians who ALJ’s do not find credible, surveillance, and understanding the employee’s response. We will identify common employer and adjuster mistakes that cause ALJ’s to grant motions for provisional orders, and we will explore alternatives to going down the 21-day suspension path.
