Application and Implications Under the Act
The subject of presumptions plays an interesting and significant role in the direction and resolution of workers’ compensation claims. While attorneys and adjusters are most likely to see this issue in action, everyone has a stake in understanding how they operate. Tim Wannemacher and Elizabeth Tull from Robinson, Kriger & McCallum and Chris Cotnoir of the Advocate Division will take us on a journey, describing the purpose and structure of presumptions and exploring the most recent interpretations of statutory presumptions, which have been increasing in recent years to include the death presumption, the retirement presumption, and the cancer presumption. In the process, we’ll gain a better understanding of how presumptions work in practice, who has the burden, and the difference between a rebuttable and unrebuttable presumption before the ALJs.
